These terms govern your use of theapexsolar.com and the communications you receive from Sexton LLC, doing business as Apex Solar ("we," "us," or "our"). By using this site or by communicating with us by phone, email, or text message, you agree to these terms.

Services

Apex Solar sells residential solar in central Illinois. We hold solar consultations with homeowners, prepare written proposals, explain the purchase and financing options available for a project, and complete the agreement if a homeowner decides to move forward.

We do not perform installation work. If you sign an agreement, your system is designed, permitted, and installed by a separate licensed solar contractor. That contractor is responsible for the installation itself, for the workmanship and equipment warranties covering the system, and for its own obligations to you. Sexton LLC is not responsible for the acts or omissions of that contractor.

Information on this website is general and does not constitute an offer, a proposal, or a guarantee of system performance, cost, savings, or eligibility for any incentive, rebate, or tax credit. Estimated production and savings figures in any proposal are estimates based on the information available at the time and are not guaranteed. Nothing on this site creates a contract. If anything on this website conflicts with an agreement you sign, the signed agreement controls.

SMS messaging terms

By providing your mobile number and agreeing to receive text messages, you consent to receive SMS messages from Apex Solar related to your consultation or project, such as appointment scheduling and confirmations, follow-up on a proposal, and replies to questions you send us. Consent to receive text messages is not a condition of purchasing any goods or services.

• Message frequency. Message frequency varies by the status of your project, up to 6 messages per month.
• Cost. Message and data rates may apply. Check with your mobile carrier for details of your plan.
• Opting out. Reply STOP to any message to opt out. After you reply STOP, we will send one confirmation message and then stop sending texts to that number.
• Help. Reply HELP for help, or contact us directly using the support details below.
• Carriers. Carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed and may be affected by network conditions.

Your mobile number and SMS consent are handled as described in our privacy policy. They are not shared with or sold to third parties or affiliates for marketing or promotional purposes.

Your responsibilities

You agree to provide accurate information about yourself and your property, to use only a mobile number you own or are authorized to use, and to tell us if that number changes or is reassigned. You agree not to use this website in a way that interferes with its operation or violates any law.

Disclaimer of warranties

This website is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that this website will be uninterrupted, error free, or free of harmful components. This section applies to the website only and does not limit or modify any warranty given in an agreement you sign or any warranty provided by the installing contractor.

Limitation of liability

To the fullest extent permitted by law, Sexton LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, or data, arising out of or relating to your use of this website or the text messages and emails you receive from us, whether based in contract, tort, strict liability, or any other theory, and whether or not we were advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability arising out of or relating to this website and these terms will not exceed one hundred dollars ($100). Liability arising out of an agreement you sign is governed by that agreement, not by this section. Nothing in these terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless Sexton LLC from any claims, damages, and reasonable attorneys' fees arising out of your violation of these terms or your misuse of this website.

Governing law

These terms are governed by the laws of the State of Minnesota, without regard to its conflict of law rules. Any dispute arising out of or relating to these terms or this website will be brought exclusively in the state or federal courts located in Minnesota, and you consent to the jurisdiction of those courts.

Changes to these terms

We may update these terms from time to time. The revised terms take effect when posted on this page, and the "Last updated" date above will reflect the change. Continued use of this website after a change means you accept the revised terms.
